Prohibits the State from denying or interfering with a female's right to choose or obtain an abortion of a nonviable fetus or an abortion necessary to protect the female's life or health. Establishes offenses related to human trafficking and provides related definitions. Provides victims of trafficking a defense to certain offenses that they may have been forced to commit. Makes trafficking victims eligible for crime victim compensation funds. Requires attorney general to report to legislature annually regarding human trafficking. Establishes task force to compile and review law and information from other states regarding support for victims of human trafficking and to recommend changes to Hawaii law and programs. Enacts a comprehensive scheme of criminal and civil remedies and services to victims of human trafficking and programs to prevent, investigate, and prosecute offenses relating to human trafficking.

SB 2200 (Relating to Child Protection)

Establishes registry of children's electronic contact points to which unsolicited messages regarding pornography, illegal or prescription drugs, alcohol, tobacco, gambling, firearms, and fireworks may not be sent; makes it a class C felony to send such messages to a registered electronic contact point and authorizes civil penalty of $5,000 per message.

Amends the law defining continuous sexual assault of a minor to permit the jury to convict if it is unanimous in finding that defendant committed at least three prohibited acts, even if it can not unanimously agree which 3 acts constitute the offense.

Proposes an amendment to article I of the State Constitution to provide that the Legislature may define what behavior constitutes a continuing course of conduct in sexual assault crimes against minors younger than fourteen years of age, and that the Legislature may define what constitutes the unanimity that is required for a conviction in sexual assault crimes. Adds a new misdemeanor of electronic enticement of a child in the third degree.

Requires that current foster care providers be the presumptive choice for adoption of a child placed in their care for more than one year unless it can be shown that it is not in the best interest of the child. (SD2)

HB 2988 (Relating to Crimes Against the Person)

Amends the definition of "person" for purposes of offenses of murder, manslaughter, and negligent injury to provide protection for a viable fetus. Defines "viable fetus." Adds provision that gestational age of 24 weeks or greater is prima facie evidence that fetus is viable.
