Hawaii’s Children & Families Score Huge Legislative Victory

“Hawaii’s children, along with the parents and community who protect them daily, scored a huge victory today with the signing of SB708 commonly known as Megan’s law,” said Kelly Rosati, Director of Hawaii Family Forum and the Hawaii Catholic Conference who was in attendance today at the Megan’s law signing ceremony in the Governor’s Executive Chambers.  Hawaii Family Forum is a non-profit, pro-family education organization committed to preserving and strengthening families in Hawaii. Hawaii Catholic Conference is the public policy arm of the Roman Catholic Diocese of Honolulu, representing over 230,000 Catholics in Hawaii.

“Megan’s law represents all that is good with public policy, ensuring parents have access to the names and locations of Hawaii’s convicted registered sex offenders who may be living in their neighborhoods near their children,” Rosati continued.

Until passage of SB708, the public in Hawaii had access to only several dozen names of Hawaii’s approximately 2,000 convicted registered sex offenders.  In November 2004, Hawaii voters overwhelmingly approved a constitutional amendment supporting public access this key child protection information.  The vote cleared the way for the Legislature to once again provide Hawaii’s public with the maximum level of transparency and child protection.

“We urge all parents to take full advantage of this crucial child protection tool by logging on today to www.sexoffenders.hawaii.gov and we thank the Governor, Lt. Governor, Attorney General, Honolulu Prosecutor and the Legislature for their leadership in protecting Hawaii’s keiki from dangerous sex offenders,” Rosati concluded.

HB 1715 HD 1 SD 1 (status) relating to civil rights.  The bill is on the way to the Governor for signature.  This bill prohibits discrimination in real property transactions on the basis of gender identity or expression, and sexual orientation.  HFF opposes this bill as written but would not take a position if suggested amendments to the bill are made.  The only remaining recourse to stop this bill is to contact the Governor and urge her to veto HB 1715 and HB 1450.  E-mail her directly at Governor.Lingle@hawaii.gov.

HB 540 HD2 Relating to Child Protection  (Status)  (HFF Testimony) HB 540 Provides immunity from prosecution for leaving an unharmed newborn at a hospital, fire station, or police station within 72 hours of birth. Provides immunity from liability for hospitals, fire stations, and police stations for receiving a newborn. Requires medical history from person relinquishing newborn.

  • DOMESTIC ABUSE PROTECTIVE ORDERS

HB 433 HD 1 Relating to Domestic Abuse Protective Orders (Status) (HFF Testimony)

This bill would allow a temporary restraining order to stay in effect until the protective order is served in instances when the respondent is not present when the protective order is orally granted.  In this way, the respondent can then be held responsible for violations of the temporary restraining order until the service of the protective order.  HFF supports this measure.

This bill is pending hearing by the Senate Health Committee.

SB 4 Relating to Medicine (Status)

This bill, if passed, would require the board of medical examiners to adopt rules governing the use of controlled substances by physicians in pain management and to train licensees thereon.   It also exempts physicians who follow the guidelines from disciplinary action by the board.
